These Terms and Conditions ('Terms') govern your use of TRKD ('we', 'us', 'our'), accessible at usetrkd.com. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Agreement to Terms

By accessing or using TRKD, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you are using TRKD on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Services

TRKD is a web-based job application tracking service that allows users to:

  • Track job applications across multiple companies and roles
  • Manage deadlines, interview schedules, and application statuses
  • Upload and store CVs, cover letters, and job descriptions
  • Use AI-powered features to analyse job descriptions and classify companies
  • Connect to third-party calendar services (Google Calendar, Microsoft Outlook)
  • Access anonymised community insights about company hiring patterns

TRKD is provided as a web application. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice to users.

3. User Accounts

To use TRKD, you must create an account. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the security of your account credentials and not share your password with others
  • Notify us immediately at privacy@usetrkd.com of any unauthorised use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

4. Prohibited Activities

You agree not to engage in any of the following activities when using TRKD:

  • Use the Services in any way that violates applicable local, national, or international laws or regulations
  • Attempt to gain unauthorised access to any part of the Services or its related systems
  • Use automated scripts, bots, crawlers, or scraping tools to extract, copy, or collect data from the platform without prior written permission from TRKD
  • Upload or submit false, misleading, or fabricated job application data, company information, or employment records with the intent to manipulate crowdsourced insights or community data features
  • Transmit any viruses, malware, or other malicious code
  • Attempt to reverse engineer, decompile, or disassemble any part of the Services
  • Use the Services to harass, abuse, or harm another person
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the integrity or performance of the Services
  • Collect or harvest any personally identifiable information from the Services
  • Use the Services for any commercial solicitation purposes without our prior written consent

5. User-Generated Content

You retain ownership of any content you upload to TRKD, including CVs, cover letters, job descriptions, notes, and application data ('User Content'). By uploading User Content, you grant TRKD a limited, non-exclusive licence to store and process your User Content solely for the purpose of providing the Services to you.

You represent and warrant that:

  • You own or have the necessary rights to the User Content you upload
  • Your User Content does not violate the intellectual property rights of any third party
  • Your User Content is accurate and not misleading

We do not use your User Content to train AI models. Data sent to third-party AI services is processed solely for the purpose of delivering the relevant feature and is governed by our Privacy Policy.

6. AI-Powered Features

TRKD uses artificial intelligence powered by Anthropic's Claude API to provide certain features including job description analysis and company industry classification. By using these features, you consent to relevant data being processed by Anthropic solely for the purpose of delivering these features.

You may opt out of AI-powered features by choosing not to upload job descriptions and not using the company name field. You must not use the AI features in any way that violates the terms or policies of Anthropic.

TRKD does not guarantee the accuracy of AI-generated outputs such as industry classifications or job description summaries. These are provided as helpful suggestions only and should be reviewed and verified by the user.

7. Community Data and Crowdsourced Insights

TRKD may use anonymised and aggregated data from user applications to generate crowdsourced hiring insights, such as company response rates and application statistics. This data is never traceable to individual users. No personally identifiable information is ever exposed through these insights.

By using TRKD you consent to your anonymised application data contributing to these aggregated community statistics. You may request exclusion from community data aggregation by contacting us at privacy@usetrkd.com.

8. Intellectual Property

The Services and their original content (excluding User Content), features, functionality, design, and branding are and will remain the exclusive property of TRKD. Our name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TRKD. You must not use such marks without our prior written permission.

Nothing in these Terms grants you any right to use any of our intellectual property. Any feedback, suggestions, or ideas you provide about the Services may be used by us without any obligation to you.

9. Third-Party Links and Services

TRKD may contain links to third-party websites or services, including job posting URLs saved by users and calendar service providers. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

When you connect a third-party calendar service (Google Calendar or Microsoft Outlook), your use of that service is also governed by that service's own terms and privacy policy. We are not responsible for how those services handle your data beyond what is described in our Privacy Policy.

10. Privacy Policy

Your use of TRKD is also governed by our Privacy Policy, available at usetrkd.com/privacy, which is incorporated into these Terms by reference. Please review our Privacy Policy, which describes how we collect, use, and share information about you when you use our Services.

11. Term and Termination

These Terms remain in effect while you use the Services. We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, if we believe you have violated these Terms.

You may terminate your account at any time by using the account deletion option in your Settings page. Upon termination, your right to use the Services will immediately cease and all your data will be permanently deleted within 30 days in accordance with our Privacy Policy.

Provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Disclaimers

THE SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from use of the Services will be accurate or reliable
  • Any errors in the Services will be corrected
  • AI-generated outputs such as industry classifications or job description summaries will be accurate

TRKD is a productivity tool. We make no guarantees about job search outcomes, interview success, or employment results arising from the use of our Services.

13. Limitation of Liability

To the maximum extent permitted by applicable law, TRKD and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorised access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount paid by you to TRKD in the twelve (12) months preceding the claim. As TRKD is currently a free service, this liability limit is zero for free-tier users.

14. Dispute Resolution

Informal Negotiations

To expedite resolution and reduce the cost of any dispute, controversy, or claim, you and TRKD agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration. Such informal negotiations begin upon written notice from one party to the other.

Binding Arbitration

If informal negotiations are unsuccessful, the dispute shall be submitted to binding arbitration in the United Arab Emirates. The arbitration shall be conducted by a single arbitrator. The arbitrator's decision shall be final and binding.

Restrictions

Arbitration shall be limited to the dispute between you and TRKD individually. No arbitration shall be joined with any other arbitration, and no class arbitration or class action shall be permitted.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the 'Last updated' date. We will also send you an email notification when material changes are made.

Your continued use of the Services after any changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, please stop using the Services.
